General Terms and Conditions of Sale (GTCS)
These General Terms and Conditions of Sale (GTCS) govern all contractual relations between the company Avenue des Vins SAS, a simplified joint-stock company with a capital of €57,520, registered with the Paris Trade and Companies Register under number 523 018 588, with its registered office at 12 rue Le Chatelier, 75017 Paris (hereinafter referred to as "Avenuedesvins.fr"), and any adult individual using the Avenuedesvins.fr website (hereinafter referred to as "the User").
1. Acceptance of the General Terms and Conditions of Sale
By accessing and using the Avenuedesvins.fr website, the User acknowledges having read and accepted these General Terms and Conditions of Sale without reservation. These GTCS apply exclusively to adult users (over 18 years old) in accordance with Article L3342-1 of the French Public Health Code. The sale of alcoholic beverages to minors is prohibited, and any order placed on Avenuedesvins.fr is exclusively reserved for adults.
2. Services Provided by Avenuedesvins.fr
Avenuedesvins.fr is an online platform that facilitates the purchase of wines directly from producers (winemakers, estates, and châteaux). Users benefit from a direct relationship with the producers, allowing access to high-quality products at advantageous prices. To access these services, the User must register on the site by completing a registration form and providing accurate and up-to-date information.
3. Ordering Terms
Orders placed on Avenuedesvins.fr are strictly reserved for adults. Avenuedesvins.fr will forward to the producer any complaint or dispute raised by the User.
4. Payment Terms
Product prices indicated on Avenuedesvins.fr are in euros and include all applicable taxes (VAT), but exclude delivery charges. Delivery costs will be calculated and displayed during the ordering process.
Avenuedesvins.fr accepts the following payment methods:
Bank card (Visa, Mastercard, Carte Bleue, Amex);
Bank check issued by a bank domiciled in mainland France, made payable to Avenue des Vins SAS. The order will be processed after the check has been cleared;
Bank transfer, effective after the amount has been received in Avenue des Vins SAS's account (3 to 5 business days);
PayPal.
Payment is made directly on Avenuedesvins.fr, which then transfers the corresponding amount to the producer.
5. Securing Online Payments
Avenuedesvins.fr uses a secure payment system via the Sogé Commerce server (a French payment solution by Société Générale bank). The User’s banking information is transmitted directly through Sogé Commerce, and Avenuedesvins.fr never has access to the User’s banking details.
6. Fraud Prevention
Avenuedesvins.fr reserves the right to request proof of identity for any order exceeding €150. If no response is received within 3 days, the order may be canceled.
7. Order Cancellation
In accordance with the French Consumer Code, the User has a period of 14 calendar days from the receipt of the products to cancel their order without giving any reason.
To exercise this right, the User must notify their decision to withdraw to the following address: 12 rue Le Chatelier, 75017 Paris.
Products must be returned in their original packaging and condition, and in perfect condition. Return shipping costs are the responsibility of the User.
The refund will be issued within 14 days of receiving the returned products, using the same payment method as used for the order, provided the products are returned in accordance with the stated conditions.
8. Delivery Times and Costs
Deliveries are made by a carrier designated by Avenuedesvins.fr. Delivery times average 7 business days from the order validation by the producer. Delivery charges are automatically calculated during the ordering process and added to the total order amount. Avenuedesvins.fr is committed to minimizing delivery costs by using its network of carriers across all producers.
9. Website Content Responsibility
Avenuedesvins.fr connects users with producers but cannot be held liable for the accuracy, truthfulness, or quality of the information provided by the producers. The producers are solely responsible for the content of their product listings, including descriptions, pricing, vintage, and quality of the wines offered.
10. Intellectual Property
The Avenuedesvins.fr website, along with all its components (including but not limited to texts, images, photos, logos, graphics, and multimedia content), is protected by intellectual property laws, particularly the French Intellectual Property Code.
Any reproduction, representation, distribution, or exploitation—whether full or partial—of the aforementioned elements, without prior and express authorization from Avenuedesvins.fr, is strictly prohibited and constitutes a violation of intellectual property rights, which may result in legal proceedings for infringement.
11. Disputes
In the event of a dispute regarding an order or payment, the parties will endeavor to resolve the issue amicably. If no agreement can be reached, the dispute will be submitted to the competent courts in Paris, in accordance with French law.
12. Validation of the General Terms and Conditions of Sale
The User acknowledges having read and accepted these General Terms and Conditions of Sale prior to confirming their order. Order confirmation implies irrevocable acceptance of the GTCS.
